Professional Experience and Expertise

○ Consulting and advising on matters relating to:
・financial compliance regulations, drawing on work experience gained at the Supervision Bureau and the Strategy Development and Management Bureau of the Financial Services Agency (FSA)
・financial regulations under the Banking Act, the Payment Services Act, the Financial Instruments and Exchange Act, the Money Lending Business Act, the Insurance Business Act, the Trust Business Act, the Act on the Protection of Personal Information, and the Act on Prevention of Transfer of Criminal Proceeds
・nonbanking businesses such as funds transfer services, cryptoasset exchange services and credit card-related services, including development of new services, fintech-related matters and supervisory guidelines, and related disputes
・compliance measures concerning anti-money laundering and countering the financing of terrorism (“AML/CFT”), corporate misconduct, and whistle-blowing hotline
・compliance measures under laws regulating financial institutions (banks, funds transfer service providers, and cryptoasset exchange service providers), including licensing, authorizations, and registrations
・legal affairs concerning Basel III framework
・structured finance/banking
・legal framework of “Orderly Resolution of Bankruptcies,” and matters under the Deposit Insurance Act and the Agricultural and Fishery Cooperatives Savings Insurance Act
・litigation and dispute resolution
○ Main Duties Performed While at the Financial Services Agency (FSA):
・Inspections and monitoring of AML/CFT measures taken at financial institutions such asbanks, funds transfer businesses, cryptoasset exchange businesses, financial instruments businesses and money lending businesses
・Follow-ups on responses concerning Guidelines on AML/CFT
・Orders for administrative disposition (AML/CFT-related) and demands for reporting
・Monitoring of financial crime countermeasures
・Responses to inquiries regarding provision of new services based on blockchain such as NCW
・Advising on Basel III regulations
・Examining qualification for issuance of AT1 bonds, Tier2 bonds, and TLAC bonds
・Handling of “Orderly Resolution of Bankruptcies” and advising on issues under the Deposit Insurance Act and the Agricultural and Fishery Cooperatives Savings Insurance Act
・Reviewing and advising on the establishment of the Working Group on Practical Lending and Revitalization Practices for Supporting the Service Providers
・Contributing to drafting of revisions to the Banking Act (enforced in November 2021) and responding to public comments for easing of regulations
・Examining and approving applications for licenses under the Banking Act (such as licenses for establishing companies or bank holding companies and licenses to bank holding companies to perform services on behalf of its subsidiaries)
・Examining and approving matters raised under the Act on Special Provisions of the Act on Prohibition of Private Monopolization and Maintenance of Fair Trade Aimed at Maintaining the Provision of Infrastructure Services Pertaining to the Regional Bus Services and Banking Services (tentative translation)
・Responding to inquiries related to the Banking Act, the Payment Services Act, the Act on Prevention of Transfer of Criminal Proceeds, and the Financial Instruments and Exchange Act and laws and regulations subordinate thereto.
○ Copious experience not only in the financial sector but also in corporate legal affairs in general including:
 ‒ Corporate/M&A
‒ Support for startups
‒ Shareholders’ meetings
‒ Lawsuits by multiple plaintiffs for purchase of shares and claims for determination of share price
‒ Debt-collection (including preservative attachment, litigation, and execution)
‒ Real estate related transactions (e.g., demand for vacation of a building, demand for payment of rent, demand for payment of apartment management fees, and responding to inquiries on laws and regulations concerning bylaws for apartment owners)
‒ Labor and employment, including formulation of internal rules, negotiation of a dismissal from employment and unpaid wages, and matters concerning labor tribunal, preservation of status and litigation
○ Criminal cases, juvenile cases, and civil cases (traffic accidents, divorce, inheritance)
